Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Excise Case No. 56 of 2020, registered under Section 30(a)/33 of the Bihar Excise Act, 2016.

The accusation is of recovery of one container containing 10 litre country made liquor from the land of the petitioner.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.36755 of 2020(2) dt.29-06-2021 2/2 petitioner has no criminal antecedent. Further submission is that it would also appear from the prosecution report that a container containing 10 litre country made liquor has not been recovered from the house of the petitioner rather the said is to be recovered from the open filed of the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Bettiah, West Champaran, in connection with Excise Case No. 56 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
