The petitioner seeks bail in connection with Runnisaidpur P. S. Case No.331 of 2021, instituted for the offences under Section 414 of the Indian Penal Code and Sections 30(a), 36, 41(1) of the Bihar Prohibition and Excise Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 03.06.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of 2300.760 litre of foreign liquor from the godown, tractor, car and two motorcycles of Shankar Singh, who fled away, but the apprehended accused

Patna High Court CR. MISC. No.48363 of 2021(2) dt.17-12-2021 2/2 persons disclosed the name of this petitioner. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case as he was not present at the place of occurrence and his name has come on the confessional statement of co-accused. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 03.06.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P. S. Case No.331 of 2021. The application stands allowed.
