====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-02-2023 Heard counsel for the petitioner and the State. This application has been filed for a direction to the respondents to ensure fair and proper investigation in connection with Pirpainti PS Case No. 44 of 2020, lodged for the offence punishable under Sections 341, 342, 323, 354B, 504, 506 and 34 of the Indian Penal Code and section 3/4 of the Witchcraft Act.
At the outset, learned counsel for the State submits
Patna High Court CR. WJC No.78 of 2021(4) dt.16-02-2023 2/2 that similar issue has already been set at rest by a coordinate Bench of this Court vide order dated 09.09.2022, passed in Cr.W.J.C No. 153 of 2017 (Surendra Singh vs. State of Bihar and Others) and other analogous cases.
Since, similar issue has already been decided by a coordinate Bench of this Court, this criminal writ petition is also disposed of in terms of aforesaid order.
