JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 394 of the Indian Penal Code. The F.I.R. relating to offence of robbery is against unknown. Name of the petitioner transpired in the confessional statement of the co-accused.
Submission of the petitioner is that petitioner is in custody since 01.10.2016. However, petitioner has not been put on Test Identification Parade as yet. There is no other material against the petitioner.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.2685 of 2017 (2) dt.20-02-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Samastipur/Successor Court, in connection with Khanpur P.S. Case No.81 of 2016.
