Petitioner seeks bail in Narpatganj P.S. Case No.242 of 2018 instituted for the offence under Section(s) 379/34 Indian Penal Code.

Counsel for the petitioner submits that informant has raised suspicion in the written report against the petitioner and Laluwa. Laluwa has already been granted bail by co-ordinate Bench of this Court by order dated 06.110.2018 passed in Cr. Misc. No.65700 of 2018.

Prosecution case, in brief, is that the informant Md. Eqbal gave a written application on 13.04.2018 alleging that the petitioner and co-accused Lalwa used to come at the shop of informant and pressurized to take the motorcycle of the

Patna High Court CR. MISC. No.37619 of 2019(2) dt.25-06-2019 2/2 informant on lower price and also wanted to give a motorcycle having Nepali registration number in exchange. On the date of occurrence, when the informant came out from mosque after offering Namaz, he found his motorcycle missing. The nearby people told that the petitioner and another accused have taken away the vehicle.

Petitioner is in custody since 29.06.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Araria, in connection with Narpatganj P.S. Case No.242 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
