The petitioners, four in number, apprehend their arrest in a case under Sections 364/380 of the Indian Penal Code. Akashvati Devi made allegation that on 29.05.2010, the accused persons came and took away different articles from her house and they also kidnapped her child.

It is submitted that occurrence is of 29.05.2010 but the petition was filed after one year and four months of the occurrence. The petitioners are in-laws of the informant. The informant killed her husband and in order to save herself lodged this case for kidnapping of her child. The police, after investigation, submitted final form finding the case false against

Patna High Court Cr.Misc. No.8154 of 2015 (2) dt.03-03-2015 2/2 the petitioners. The case was found true only against Somindra Yadav, who is not the petitioner.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in Marauna P.S. Case No. 87/2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
