JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-02-2021 Heard learned counsel for the petitioner and Mr. Gauri Shankar Gupta, learned A.P.P. for the State. This is the second attempt of the petitioner to obtain regular bail in connection with Phulparas P.S. Case No. 114 of 2018 registered for the offence under Sections 341, 323, 384, 386, 427, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Considering that the petitioner has got 30 cases on his head, this Court had earlier rejected the prayer for bail of the petitioner vide order dated 11.12.2019 passed in Cr. Misc. No. 76578 of 2019.

A report from the learned trial court has been received vide letter no. 49 dated 06.02.2021. The learned Judicial Magistrate has informed this Court that the case is fixed for

Patna High Court CR. MISC. No.36600 of 2020(3) dt.24-02-2021 2/2 framing of charge on 18.02.2021 and the trial will be conducted on day to day basis to conclude the same within a period of three months.

In view of the report of the learned court below that the trial will be concluded within a period of three months, this Court is not inclined to grant privilege of regular bail to the petitioner.

Hopefully, the trial court must have framed charge on 18.02.2021, if not, the charge shall be framed on the very next date. For this purpose, all concerned including the prosecution shall cooperate by complying with the order of learned trial court. The trial shall be concluded by taking it on day to day basis.

In case the trial is not concluded, for no reasons attributable to the petitioner, within a reasonable period, the petitioner may renew his prayer for bail.
