The petitioner apprehends his arrest in Pipra P.S. Case No. 07 of 2014, registered for the offences punishable under Sections 353, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner along with other accused persons assaulted the informant and other police officials. It is further alleged that they forcibly made him sit in the motorcycle and took him to Shyam Nagar and assaulted him and also snatched Rs. 2000/- from his pocket. Due to assault the knee of informant got fractured.

It is submitted that petitioner has falsely been implicated in this case. Prior to the present FIR informant has lodged two cases for the same occurrence. As a matter of fact,

Patna High Court CR. MISC. No.41189 of 2022(2) dt.29-11-2022 2/2 he was not present at the place of occurrence. Entire allegation is false and fabricated.

Counsel for State opposed the prayer for bail. Considering the nature of accusation and the fact that due to assault by the accused persons including petitioner fracture caused in the knee of informant, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
