The petitioner seeks bail in Hathua P.S. Case No.140 of 2016 instituted for the offence under Sections 394 and 307 of the Indian Penal Code.
It is alleged that, on the date of occurrence, two persons on the motorcycle attempted to snatch the motorcycle of the informant. Further it is alleged that one of the co-accused gave Chaku blow on the head and neck of the informant. The informant raised Hulla then one person who was tall and fat fled away from the motorcycle of the informant. Co-villagers arrived and caught another person who was short in height, who disclosed his name as Pradeep Kumar (petitioner). The injury report of the informant has been annexed as Annexure-2 wherein the doctor has found the
Patna High Court Cr.Misc. No.4351 of 2017 (2) dt.10-02-2017 injury on the person of the informant as simple in nature. From the written report, it is not clear who gave the Chaku blow to the informant. The petitioner is said to be in custody since 11.07.2016. It is mentioned in paragraph 3 of the petition that the petitioner has no criminal antecedent. In the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Gopalganj in connection with Hathua P.S. Case No.140 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
