JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 24.03.2015 Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Petitioner happens to be father-in-law of the deceased who died within two years of her marriage in mysterious circumstance. There is allegation of demand of dowry as well as torturing in connection with marriage of the deceased.

Accordingly, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Kundwa Chainpur P.S. case no. 62/2014 pending in the court of Sri S.K. Mishra, Judicial Magistrate, Ist Class, Sikrahana, East Champaran/concerned court stands rejected.

However, if the petitioner surrenders within four weeks from today and seeks regular bail, the competent court shall consider

Patna High Court Cr.Misc. No.5270 of 2015 (3) dt.24-03-2015 regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
