The petitioners seek bail in anticipation of their arrest in connection with Deodha P.S. Case No. 44 of 2020 (CRI Case No. 575 of 2020), dated 07.04.2020, instituted

Patna High Court CR. MISC. No.36015 of 2020(2) dt.05-04-2021 2/3 for the offences under Sections 341, 323, 325, 353, 427 and 34 of the Indian Penal Code.

The petitioners are said to have damaged the saplings and assaulted the informant when he prevented them from doing so.

The learned counsel for the petitioners has submitted that the F.I.R. has been lodged by the Guard of the Forest Department, who is the resident of the same village as that of the petitioners. The accusation levelled in this case against the petitioners is because of some other dispute with the informant.

Considering the nature of accusation against the petitioners, they, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Deodha P.S. Case No. 44 of 2020 (CRI Case No. 575 of 2020), subject to the conditions

Patna High Court CR. MISC. No.36015 of 2020(2) dt.05-04-2021 3/3 laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
