JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Buxar (T) P.S. Case No. 391 of 2016, registered under Section 341, 323, 353 and 307 of the Indian Penal Code and Section 52 of the Prisoner Act.

The accusation is that petitioners and one Karan Singh were kept in Buxar Central Jail and they called Budul Yadav, who was also an under trial prisoner, but Budul Yadav refused to go near the petitioners, then petitioners and other assaulted him, when nearby persons tried to save Budul Yadav then they were also assaulted by the accused-petitioners. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.4875 of 2017 (2) dt.03-03-2017 2/2 petitioners are innocent and they have falsely been implicated in this case. The petitioners are in custody since 26.09.2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No.391 of 2016.
