JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468 and 120B/34 of the Indian Penal Code.

The prosecution case is that the father of the informant Raghunath Pd. Yadav contacted with the petitioner for purchase of three katha 14 dhurs land situated in village Hakpara, Mohalla Shivpuri, Ward No. 14, Saharsa for which the petitioner was paid `20,005/- when agreement to sale was prepared but neither the sale deed was executed nor the money was returned. It is submitted by learned counsel for the petitioner that only part of the consideration money alleged to had been paid to the petitioner on 26.07.2003 whereas the present FIR has been lodged in the year 2016 and there is no proof with regard to payment.
