For the Petitioner/s : Mr. Rao Kundan Kumar Karmvir For the Respondent/s : Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the respondent. By the impugned order dated 18.07.2014, the Court below has rejected the application filed by the petitioner for amendment in the written statement recording a clear finding that in the aforesaid fact which is now sought to be introduced is already there in the written statement.

Therefore, in view of this finding recorded by the Court below, the amendment sought for is not necessary for just decision of the controversies between the parties. Therefore, I find no reason to interfere with the impugned order because the evidence of the plaintiff has already been concluded. Thus, this writ application is dismissed.
