KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 27-09-2021 The petitioner has prayed for the following relief/s :- i. The respondents may kindly be commanded/directed to ensure immediate payment in favour of all the teaching and non-teaching employees from the Affiliated-cum-Government or Aided Degree Colleges (except one or two exceptional Colleges) running under the Jai Prakash University, Chapra. ii. All the respondents further may kindly be directed to take necessary step to ensure immediate payment in favour of the above said deserving

Patna High Court CWJC No.981 of 2021 dt.27-09-2021 2/3 candidates who are getting nothing towards pay/grant or emoluments from the year 2011 till date, without any valid or cogent reason.

Iii. The respondents also may kindly be directed to short out the difficulties immediately, even if any subsist, in extending the legitimate claim/payment in favour of the candidates above said.

iv. Any other relief of reliefs also may kindly be allowed for which the petitioners be found entitle in the opinion of this Hon'ble Court."

After the matter was heard for some time, finding the Court not to be in favour with the submissions made across the bar, learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition reserving liberty to approach the Government/appropriate authority venting out the grievances, subject matter of the present petition in accordance with law.

We see no reason to disallow such prayer.

As such, petition is permitted to be withdrawn reserving liberty as prayed for.

We clarify that it shall be open for the authorities concerned to take a decision in accordance with law. We have not expressed any opinion on the merits of the case and all issues are left open.

Petition stands dismissed as withdrawn with the

Patna High Court CWJC No.981 of 2021 dt.27-09-2021 3/3 liberty aforesaid.

Interlocutory application(s), if any, shall stand disposed of.
