The instant application has been filed by the petitioner for anticipatory bail apprehending his arrest in connection with Amarpur P.S. Case No. 387 of 2016, registered for the offence under Section 409 of the Indian Penal Code.
The allegation as per the FIR lodged by the Block Education Officer is that in the year 2016, he wrote a letter to the petitioner to provide him the merit list proceeding register as also the counselling register for the year 2006 but he did not receive any reply from the petitioner and, as such, as per the direction received, the FIR was lodged.
It is submitted by the learned counsel for the petitioner that the petitioner retired on 31.05.2011 from the
Patna High Court CR. MISC. No.35487 of 2019(2) dt.04-06-2019 2/2 post of Block Education Officer, Amarpur. No proceeding was started against him in his service period and as per the FIR, records of 2006 is being asked for from the petitioner in the year 2016. Further it is submitted that petitioner has no criminal antecedent.
Having heard the parties and considering the facts and circumstances stated hereinabove, the above named petitioner is directed to surrender in the court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 387 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Partha Sarthy, J) sushma/- U T
