JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jehanabad Mahila P.S. Case No. 34 of 2014 registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
Admittedly, petitioner is father in law of the deceased and he as well as his other family members are named in the first information report with allegation that they used to torture the deceased due to non fulfilment of dowry demand and later on, they committed the murder of the deceased for their above stated lust.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant the
Patna High Court Cr.Misc. No.4744 of 2015 (2) dt.05-02-2015 privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Jehanabad Mahila P.S. Case No. 34 of 2014 pending in the court of Smt. Namita Singh, Judicial Magistrate 1st Class, Jehanabad stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
