JUSTICE ARUN KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner, who is in custody, seeks bail in connection with Bajpatti P.S.Case No. 42 of 2016 registered under Sections 147, 149, 341, 448, 323, 324, 307, 302 and 504 of the Indian penal Code.

Allegation against this petitioner is that he assaulted on the head of the informant with sharp cutting weapon. It is submitted that the allegation of assault to the deceased is not against this petitioner. The specific allegation of assault to deceased is against one Nand Kishore Mandal and the injury no. 1 on the person of the informant is simple in nature and opinion was kept reserved with regard to other injury and this petitioner has no criminal antecedent and the other co-accused of

Patna High Court Cr.Misc. No.6163 of 2017 (2) dt.08-02-2017 2/2 this case have been granted bail by a co-ordinate Bench of this Court, namely, Kaushalya Devi by order dated 29.07.2016 in Cr. Misc. No. 29947 of 20126, Lalu Mandal and Visheshwar Mandal by order dated 23.09.2016 in Cr. Misc. 38027 of 2016 and Tapeshwar Mandal by order dated 23.12.2016 in Cr. Misc. No. 54649 of 2016, moreover, this petitioner is in custody since 20.05.2016.

Having considered the aforesaid facts and circumstances of the case, let the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Pupri at Sitamarhi in connection with Bajpatti P.S. Case No. 42 of 2016 (G.R. No. 189 of 2016).
