The petitioner apprehends his arrest in Kharagpur P.S. Case No. 211 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code. The informant lodged the case against unknown for theft of coat.
Learned counsel for the petitioner submits that the name of the petitioner figured in the case in the confessional statement of one Md. Riazul who is alleged to have stated that he along with Md. Manobar @ Mannu and Md. Taqdir @ Kismat and the petitioner committed theft in different places. It is further submitted that nothing has been recovered from the possession of the petitioner and except the confessional statement of co-accused, no cogent evidence has been collected to show the involvement of
Patna High Court Cr.Misc. No.3995 of 2015 (2) dt.29-01-2015 the petitioner.
Having considered the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 211 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
