The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Prosecution case is that the informant fixed marriage of his daughter namely, Neha Kumar with co-accused Raju Sharma and thereafter engagement was done. Subsequently, Rs.1,50,000/- was given to the father of prospective bridegroom namely Mahendra Sharma. Thereafter, further demand for dowry was made and on non-fulfillment of the same the marriage could not be performed.
It is submitted by learned counsel for the petitioners that the petitioners are maternal aunt and brother-in-law of the
Patna High Court Cr.Misc. No.24388 of 2016 (2) dt.31-05-2016 2/2 prospective bridegroom Raju Sharma. Moreover, the thrust of accusation is against co-accused Mahendra Sharma, father of the prospective bridegroom.
Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad, in connection with Dehri (Indrapuri) P.S. Case No.163/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
