This application is for grant of bail in connection with Darpa P.S.Case No.62 of 2016 for the offence under Section 30 (a) of Bihar Excise (Amendment) Act, 2016.
It is submitted on behalf of the petitioner that the petitioner is the Driver of the Vehicle and it is alleged that 108 ltr. of Nepal-made liquor has been recovered from the Vehicle. The petitioner has clean antecedent and he is in custody for about four months.
Heard learned A.P.P. also.
Having heard both sides. In view of the fact that huge quantity of Nepal-made liquor has been recovered from the petitioner, as such I am not inclined to grant bail to the petitioner
Patna High Court Cr.Misc. No.2807 of 2017 (2) dt.09-02-2017 2/2 at this stage, however, the petitioner may renew his prayer for bail, after completion of six months in the custody, before the court below itself and the court below considering the period of detention, will dispose of the bail application of the petitioner on the say day.
With the aforesaid observation, this application is disposed of.
