For the Petitioner/s : Mr. Arvind Kumar Singh, Advocate For the Opposite Party/s : Mr. Uma Nath Mishra, APP ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL ORDER 28-08-2015 The Petitioner seeks cancellation of anticipatory bail granted to the private Opposite Party by order dated 17.12.2014 passed by the Sessions Judge, Munger vide A.B.P. No.783 of 2014 and 788 of 2014 arising out of Kasim Bazar P.S. case No.150 of 2014 on the ground that the gravity of offence did not demand such an order nor were the private Opposite Parties entitled to grant of anticipatory bail since the regular bail applications of similarly placed other accused persons had been rejected by this Court.
Having considered that it was after due consideration of the materials on record that the Court below had exercised its discretion in favour of the private Opposite Party and there is no
Patna High Court Cr.Misc. No.5084 of 2015 (2) dt.28-08-2015 2/2 material on record to show that they misused the privilege of anticipatory bail thereafter, I do not find any reason for interference.
