2. Petitioner is apprehending his arrest in connection with Bhabhua P.S. Case No.806 of 2023, registered for the offence punishable u/s 420, 406 and 409 of the IPC.

3. As per the prosecution case, this is a case of embezzlement of Government money of Rs. 30,48,000/.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior motive. The petitioner 'who was District Co-ordinator of Kaimur District' has no role in preparing the list of toilet beneficiaries nor he is responsible for making payment. There is

Patna High Court CR. MISC. No.41571 of 2024(2) dt.02-08-2024 2/2 no documentary evidence to suggest that the petitioner had requested the informant to make payment of 140 beneficiaries nor any payment was made to the said 140 beneficiaries. Petitioner has no criminal antecedent.

5. Learned APP for the State opposes the prayer of anticipatory bail and submits that this case relates to embezzlement of Government money of Rs. 30,48,000/- and during inquiry headed by Director of District Rural Development Agency, the petitioner along with co-accused persons have found involved.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.
