JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Harsidhi P.S. Case No. 74 of 2014 registered under Sections-341, 447, 323, 324, 307, 504, 379/34 of the Indian Penal Code. Admittedly, the informant and petitioners are full brothers and an altercation took place between them on account of dispute of partition. The impugned order of learned Sessions Judge reveals that all the injured of this case sustained simple injury. Moreover, it is pointed out on behalf of the petitioners that the parties have amicably settled their dispute which is evident from perusal of Annexure-3 to this petition.

Patna High Court Cr.Misc. No.7378 of 2015 (2) dt.27-02-2015 2/2 Taking into consideration the above-said facts and circumstances as well as submission of the parties, the petitioners named-above, in the event of arrest or surrender in the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Harsidhi P.S. Case No. 74 of 2014 to the satisfaction of Chief Judicial Magistrate, Motihari subject to conditions as laid down u/S 438(2) of the Cr. P.C.
