The petitioners seek bail in a case registered under Section 379 of the Indian Penal Code.

The prosecution case, in short, is that the informant used to live in the house of one Manju Devi and used to park his vehicle in garage of one Sajjan Jee, where Md. Laddan, Aftab and Nawab also used to park their vehicles. As usual the informant parked his vehicle in the said garage on 12.02.2019 and on 13.02.2019 he did not find his vehicle there. It has been submitted on behalf of the petitioners that the petitioners are in custody since 23.02.2019 and have got no

Patna High Court CR. MISC. No.35611 of 2019(3) dt.01-07-2019 2/2 criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are not named in the F.I.R. Their name has transpired in this case on the basis of confession of co-accused. No incriminating article has been recovered from the conscious possession of the petitioners. The petitioners have not been put on T.I.P.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Sohsarai P.S. case No.27 of 2019.
