JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-12-2022 At the outset, It is submitted by learned counsel for the petitioners that he seeks permission to withdraw this application against petitioner no.1 namely, Md. Samsul Ansari. Permission is accorded.
This application is dismissed as withdrawn against petitioner no.1 namely, Md. Samsul Ansari.
So far as rest of the petitioners are concerned, the instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Pipra P.S. Case no. 74 of 2022 instituted for the offence under
Patna High Court CR. MISC. No.39339 of 2022(2) dt.01-12-2022 2/3 Sections 341, 342, 323, 324, 385, 379, 504, 506, 34 of the Indian Penal Code.
As per allegation of FIR, when the informant was coming from shop, the petitioner along with co-accused persons surrounded him and demanded 50,000/- as extortion. On protest, they assaulted to the informant and snatched Rs. 25,000/- from his pocket and a golden chain worth of Rs. 65,000/-. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. The informant and the petitioners are co-villagers and a social dispute between them due to which petitioners have falsely been made accused in this case. The injuries sustained by the informant are simple in nature. It is fuhrer submitted that ransom demand was not executed.
Learned APP appearing for the state has opposed the prayer of anticipatory bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners except petitioner no.1 Md. Samsul Ansari on Bail. The petitioner nos. 2, 3 & 4 are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in
Patna High Court CR. MISC. No.39339 of 2022(2) dt.01-12-2022 3/3 connection with Pipra P.S. Case no. 74 of 2022, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Supaul subject to the conditions as laid down under section 438(2) of the Cr.P.C.
