Petitioner is in custody since 30.08.2016 in connection with Sarairanjan P.S. Case No. 203 of 2016 registered under Sections 363, 366(A) of the Indian Penal Code.

Accusation is of kidnapping of daughter of informant. 4.

Learned counsel for the petitioner has submitted that there was love affair between the co-accused Nandan Kumar Sah and the daughter of the informant and they have performed marriage with the sweet will of the daughter of the informant. This petitioner, who only happens to be a friend of Nandan Kumar Sah, has no role to play in the entire matter. There is no specific allegation of abduction against this petitioner and merely on the basis of suspicion, the petitioner has been made accused in this case and rotting in custody for more than four months.

Considering the facts and circumstances of the case and nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Samastipur in connection with Sarairanjan P.S. Case No. 203 of 2016.
