The petitioner apprehends his arrest in a case registered under section 414 and other allied sections of the Indian Penal Code.

The police arrested one Vikash Kumar and from his possession one stolen mobile was recovered in which SIM No. 9199620330 was put. Vikash Kumar disclosed the name of the petitioner but nothing has been recovered from the possession of the petitioner.

It is submitted that the petitioner has got no criminal antecedent. Except the confessional statement of coaccused Vikash Kumar, no tangible evidence is collected by the police to show involvement of the petitioner in committing theft of

Considering the facts aforesaid, the above named petitioner, in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Siwan P.S. Case No. 13/2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
