JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-03-2015 Heard learned counsels for the petitioner and the State. The petitioner no.1 being the second wife of the husband of the informant and petitioner nos. 2 and 3 being the son and daughter-in-law of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 494, 498A and 504/34 of the Indian Penal Code. It is alleged that the petitioners assaulted the informant. It is submitted by learned counsel for the petitioners that specific accusation of assault is against the husband of the informant who has been granted regular bail.
Considering the fact that specific accusation of assault to the informant with iron rod is against petitioner no.2, this Court
Patna High Court Cr.Misc. No.4942 of 2015 (2) dt.10-03-2015 2/2 is not inclined to grant him anticipatory bail. Let the learned court below consider the prayer for regular bail of petitioner no.2 if he surrenders within a period of six weeks.
So far as petitioner nos. 1 and 3 are concerned, since the accusation of assault against them is omnibus and general, the injury has been found to be simple and they are ladies, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Bela P.S. Case No. 69 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
