JUSTICE SHIVAJI PANDEY ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. In this case, the petitioner is seeking regular bail in connection with POCSO Case No. 81 of 2019, arising out of Sasaram Town P.S. Case No. 767 of 2019 registered for offence punishable under sections 341, 323, 354(B), 302, 506, 34 of the Indian Penal Code, section 27 of the Arms Act and section 8 of the POCSO Act.
The petitioner had earlier moved before this Court for grant of regular bail in Cr. Misc. No. 3814 of 2020 and this Court, vide order dated 29.05.2020, rejected the bail of the petitioner.
This Court has perused the case diary and learned counsel for the petitioner has drawn attention of this Court to
Patna High Court CR. MISC. No.2375 of 2021(4) dt.07-04-2021 2/2 the paragraph 9 and the statement of the witnesses and submitted that the petitioner was not the person who killed the victim, but the FIR and paragraph 9 and 10 of the case diary itself depicts that there is a direct allegation against this petitioner to have killed the victim.
In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly, his prayer for grant of bail is rejected. However, the court below is directed to expedite the trial and conclude the same within a period of one year from the date of receipt/production of a copy of this order.
