Petitioner is apprehending arrest in a case registered under sections 395, 397, of the Indian Penal Code and 3, 4 Explosive Substance Act.

Accusation is of committing dacoity in the house of the informant. The first information report was lodged against 30-35 persons. During the investigation it transpired that prior to the commission of dacoity miscreants stayed in the house of the petitioner and made preparation to commit dacoity. It is submitted by the learned counsel for the State that there are sufficient materials collected during investigation against the petitioner.

Patna High Court Cr.Misc. No.4963 of 2015 (7) dt.07-08-2015 2/2 Considering the nature of accusation, this court is not inclined to grant bail to the petitioner. This order will not prejudice the learned court below in consideration of prayer for regular bail.
