The petitioner seeks bail in connection with Jhajha P.S. Case No.105 of 2016 registered under Section 364(A) of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of the written report of the informant, for the kidnapping of his father for ransom, the present case was lodged against unknown on 18.06.2016. On the next day, the father of the informant was found at his house and in his statement, the father of the informant has stated he was carried by four persons while he was on the way for boarding the train. The father of the informant, later on, stated that the four persons, who had kidnapped him and kept him in a room, were talking to each other
Patna High Court Cr.Misc. No.3418 of 2017 (3) dt.15-03-2017 2/2 taking the name of Nilu, Pintu and Amarjit (petitioner). While the father of the informant has stated that four persons had kidnapped him forcibly boarding him on the motorcycle but the petitioner has not been put on T.I. Parade. The petitioner is in custody since 20.09.2016. While the petitioner is accused in three other cases, as detailed in paragraph-3 to this application, but in all that cases, the petitioner is on bail.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case No.105 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
