This application for grant of anticipatory bail arises out of Jandaha P.S. Case No. 123/2015, disclosing offences under Section 387 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.
The petitioner was not named in the First Information Report. It appears that in course of investigation, co-accused Santosh Rai and Manoj Kumar confessed the guilt before the police and disclosed the name of the petitioner. Considering the gravity of the offence, I am not inclined to grant the privilege of anticipatory bail to the petitioner. The application for anticipatory bail on behalf of the petitioner is rejected.
The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
