The petitioner is accused in connection with Bodhgaya P.S. Case No. 289 of 2016, registered under Section 363 and 366(A) of the Indian Penal Code.

The accusation is of kidnapping of minor daughter of the informant by this petitioner with intention to perform marriage.

Learned counsel for the petitioner submits that the victim, daughter of the informant was major and she left her parental house according to her sweet will and performed marriage with this petitioner. Further submission is that in the statement recorded under Section 164 of Cr.P.C. of the victim, she clearly stated about moving with this petitioner according to

She also showed her willingness to live with this petitioner. Further submission is that in Medical Examination, the age of the victim has been assed as 18 years on 23.09.2016. The petitioner is in custody since 12.09.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Bodhgaya P.S. Case No. 289 of 2016.
