2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

3. As per prosecution case, petitioner and other coaccused persons conspired and killed the brother of the informant and threw his dead body in a well.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He further submitted that the informant is not an eye witness of the occurrence, he has only raised suspicion that on account of old land dispute the accused persons have killed his brother. Similarly situated co-accused persons have already been granted

Patna High Court CR. MISC. No.37653 of 2025(2) dt.01-08-2025 2/2 bail by Co-ordinate Bench of this Hon'ble Court vide order dated 10.05.2024 passed in Cr. Misc. No. 26262 of 2024 and order dated 03.05.2024 passed in Cr. Misc. No. 8828 of 2024. There is no material against the petitioner and he is in custody since 07.04.2025. Petitioner has got no criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - II, Sheikhpura in connection with Ariyari P.S. Case No. 308 of 2023.
