JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Barachatti P.S. Case No. 345 of 2016 registered under Sections 272, 273, and 120(B) of the Indian Penal Code and Section 47(a), 48(2), 54 and 63 of the Excise Act.
The accusation is of recovery of 71.6 litres in several bottles, containing in cartoon, from the Indica Car vehicle, bearing registration no. BR02W-8381, which was driven by this petitioner and the said vehicle was belonging to one Rajesh Kumar. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 05.09.2016.
Patna High Court Cr.Misc. No.1767 of 2017 (2) dt.20-01-2017 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Barachatti P.S. Case No. 345 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
