JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chandi Police Station Case No.147 of 2018 registered for the offences punishable under Sections 341, 323, 307, 302, 504, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
As per F.I.R., the petitioner is said to have fired at Chandeo Singh causing injury and there is further allegation that when the cousin brother of the informant, namely, Pankaj Kumar heard the sound of firing, he reached at the place of occurrence and he was shot dead by co-accused Sughar Yadav. Submission of learned counsel for the petitioner is that though there is allegation against the petitioner that he had fired at Chandeo Singh but there is no injury on the record. On the other hand, learned A.P.P.. has submitted
Patna High Court CR. MISC. No.37567 of 2019(5) dt.24-10-2019 2/2 that the case diary discloses that Chandeo Singh has firearm injury in his person and he has also named this petitioner. Having heard both sides and in view of the above facts as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, above named. However, the petitioner is directed to surrender before the learned court below and make prayer for regular bail which shall be considered on the basis of material available on the record.
