Petitioner Nos. 2 to 5 are apprehending their arrest in connection with a case registered for the offence under Section 307 and other allied Sections of the Penal Code. They are named in the First Information Report. It is submitted on their behalf that injuries attributed to them is not grievous, there is counter case also and in appreciation of such fact they be admitted to the privilege of bail in the event of arrest.
Patna High Court Cr.Misc. No.41332 of 2014 (3) dt.10-04-2015 2/2 Let Petitioner Nos. 2 to 5, named above, surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order in the court below and thereafter apply for bail, which should be considered in the light of the materials in the case diary including the injury-report. Until verification of the injuries attributed to them, no coercive steps be taken against Petitioner Nos. 2 to 5. Those petitioners to whom there is no grievous injury attributed, they be admitted to the privilege of bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Mishra, Judicial Magistrate, 1st Class, Sikrahna at Motihari, District- East Champaran in connection with Ghorasahan (Jitna) P.S. Case No. 36 of 2014, G.R. No. 125 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
