Delay in filing the instant appeal stands condoned. The instant memo of appeal is directed against the order dated 23.08.2018 passed by a learned Single Judge of this Court in C.W.J.C. No. 13701 of 2018, titled as Anant Kumar Vs. The Institution of Engineers (India) & Ors., whereby the writ petition has been dismissed.
Patna High Court L.P.A No.1470 of 2018 dt.31-01-2020 2/3 The impugned order dated 23.08.2018 passed in C.W.J.C. No. 13701 of 2018, titled as Anant Kumar Vs. The Institution of Engineers (India) & Ors. is reproduced herein under:- The petitioner has been awarded only 28 marks out of 100 in the subject 'Manufacturing Science' paper of Section-B examination held by the Institution of Engineers (India). It is his case that he had expected at least 50 out of 100 in the said paper. It has been vaguely stated in the writ application that upon inspection of the answer sheet, which the petitioner had an occasion to inspect, he has found that his answer sheet has been arbitrarily examined. Such vague plea cannot make a sustainable foundation to consier the petitioner's case for directing the respondents to re-evaluate his answer sheet.
I do not find any merit in this application. This application is dismissed."
From the record it could not be shown as to how the order is perverse. The Statute does not provide for re-evaluation, that apart, the learned Single Judge rightly held the averments in the petition, qua the petitioner's expectation of higher marks, to be unfounded.
As such, we find no reason for interfering with the
Patna High Court L.P.A No.1470 of 2018 dt.31-01-2020 3/3 order impugned herein.
The appeal stands dismissed.
