Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

This is a case of misuse of privilege of bail. Misuse was committed in the year 2001 and petitioner is in custody since 11.04.2019. The offence alleged is under Section 302 I.P.C. and other sections of the I.P.C.

Considering the fact that the case is running for prosecution evidence, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of receipt of a copy of this order on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with

Patna High Court CR. MISC. No.39005 of 2019(2) dt.26-06-2019 2/2 two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No.565 of 1999 arising out of Bihta Police Station Case No.09 of 1998, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
