JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-01-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of opposite party. The petitioner is in custody in connection with Bhagwanpur P.S. Case No. 216 of 2019 for the offences under Section 392 of the Indian Penal Code.

The petitioner is alleged to have looted motorcycle, cash and other articles of the informant along with three other miscreants.

Learned counsel appearing on behalf of the petitioner would submits that petitioner is a student and he has not been named in the F.I.R. The name of the petitioner surfaced in this case on the confessional

The petitioner is in custody since 13.12.2019. Considering the fact that F.I.R has been lodged against unknown, petitioner is a student and the period of custody, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 216 of 2019, subject to the condition that one of the bailors should be the teacher of the petitioner where the petitioner is pursuing his study.
