JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 302/34 and other allied sections of the Indian Penal Code.
As per the prosecution case, petitioner and other accused persons assaulted daughter of the informant causing her death.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. As a matter of fact, some altercation took place between the parties in which informant's daughter fell down as a result of the she sustained injuries and died thereof. Doctor has also not found any external or internal injury on her person. More so, there is general and omnibus allegation of assault against the petitioner and no

Similarly situated co-accused Seema Devi has already been granted regular bail by a co-ordinate bench of this Court vide Cr.Misc.No. 29131/2020. Petitioner is a lady and has got clean antecedent. Learned counsel for the State opposes the prayer for bail. He submits that the petitioner is named in the FIR with specific allegation that she and other accused persons assaulted daughter of the informant causing her death.
Considering the specific allegation against the petitioner, her prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) shashi/- U T
