2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-b)a, 26, 35 of the Arms Act.
3. According to the FIR, prosecution case relates to recovery of one loaded country made pistol from possession of the petitioner while he was trying to escape after seeing the police party.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has no concern with the alleged arms which was seized by the police or with the co-accused persons. It is further submitted that the
Patna High Court CR. MISC. No.39567 of 2023(3) dt.07-08-2023 2/2 petitioner was arrested in Naugachia P.S. Case No. 388 of 2022 and thereafter he was remanded in this case on 9.2.2023 and since then, he is languishing in judicial custody.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Naugachia P.S. Case No. 23 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Naugachia, Bhagalpur.
