The petitioner has made this application for bail in connection with Bachhawara P.S.Case No.12 of 2019 registered for the offences under Sections 25(1-b) a, 26 and 35 of the Arms Act.

The allegation as per the F.I.R. is that on checking the car of this petitioner, a loaded country made pistol with two live cartridges were recovered from his possession.

The alleged seizure list is not in accordance with law, the petitioner has no criminal antecedent and he is in custody since 14.01.2019.

The application for bail is opposed by the learned A.P.P. for the State stating that a loaded country made pistol with two live cartridges has been recovered from possession of the petitioner.

Having heard the learned counsel for the petitioner as also the learned A.P.P. for the State and taking into consideration the facts and circumstances of the case specially that the petitioner has no criminal antecedent and he is in custody since 14.01.2019, the Court is inclined to enlarge the petitioner on bail. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in Bachhawara P.S.Case No.12 of 2019. aks/- (Partha Sarthy, J) U
