08-06-2015 The petitioners apprehend their arrest in relation to Garkha P.S. Case No. 170/2012 registered under Sections 147, 149, 149, 341, 323, 302, 504 of the Indian Penal Code.
Learned counsel for the petitioners firstly submits that as per the post mortem examination report the cause of death has not been asserted. The allegation in the First Information Report is that the six persons including the four petitioners brutally assaulted the victim with Lathi. No injury is found to justify the allegations. The victim was unconscious with no apparent injury leading to his death. It is further submitted that police after investigation submitted final report not sending up the four petitioners on trial,
Patna High Court Cr.Misc. No.17241 of 2015 (2) dt.08-06-2015 subsequently, under Section 319 Cr.P.C. the petitioners have been summoned and as said apprehend their arrest. Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge, Saran, Chapra, in connection with S. Tr. No. 650/2013, Garkha P.S. Case No. 170/2012, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
