The petitioner seeks bail in Korha P.S. Case No. 28/2019, instituted for offence under Section(s) 302, 201 of the Indian Penal Code.

It is alleged in the written report that during patrolling duty informant/ Chaukidar got information that one dead body is lying in the river. The informant reached there and took out the dead body from water and registered case against unknown. During investigation mother of deceased raised suspicion against this petitioner.

Case diary has been received.

Learned Addl. P.P. has submitted that besides suspicion there is no allegation of overt act against this

Learned counsel for petitioner has submitted that police arrested this petitioner on the basis of C.D.R. The police recorded his confessional statement. Mere suspicion has been raised against this petitioner.

Petitioner is in custody since 22.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Korha P.S. Case No. 28/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
