JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Akbarpur P.S. Case No. 08 of 2015 registered for the offence under Sections-376/511 of the Indian Penal Code. Taking into consideration the allegation levelled against the petitioner as well as facts and circumstances of the case, I do not think it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, prayer for anticipatory bail of the petitioner in connection with Akbarpur P.S. Case No. 08 of 2015 pending in the court of learned Chief Judicial Magistrate, Nawada/concerned court stands rejected.
However, if, the petitioner surrenders in the court
Patna High Court Cr.Misc. No.14855 of 2015 (2) dt.10-04-2015 2/2 below and seeks regular bail, this order shall not cause any prejudice to the learned court below at the time of consideration of regular bail application of the petitioner.
