====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 27-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Udwant Nagar P.S. Case No.136 of 2016 registered under Sections 302 and 201/34 of the Indian Penal Code.

The allegation of the informant Veena Kumari is that on 08.03.2016 at about 06.00 P.M in the evening., her mother Lalti Kunwar received call of a person on her mobile and, thereafter, her mother moved from the house instructing her and her sister Rinku Kumari to cook the meal, saying that she will return very soon but she did not return till 08.00 P.M. in the night. The informant tried to contact her mother on her mobile but her mobile

Patna High Court Cr.Misc. No.2062 of 2017 (3) dt.27-02-2017 2/3 was found switched off. Thereafter, the informant started to search her mother but no trace of her was found. On 10.03.2016 at about 08.00 A.M. in the morning, the informant received information about lying of a dead body in a well of Suryanath Singh in village-Masarh, then the informant alongwith her family members went there and information to this effect was given to the police. The dead body was removed from the well by the police and the informant identified the dead body as of her mother. Several cut injuries were found on the person of the mother of the informant.

The informant raised suspicion against the petitioner, his wife and son having their hands in committing the murder of her mother as, earlier, she was given threatening by the petitioner, his wife and son to kill her and on the date of occurrence, in the evening at about 06.00 P.M., the petitioner was seen moving in the southern direction of the village and he was seen returning from the southern direction of the village towards his house.

Patna High Court Cr.Misc. No.2062 of 2017 (3) dt.27-02-2017 3/3 commission of the murder of the deceased Lalti Kunwar, the mother of the informant. In fact, due to enmity and grudge, the petitioner, his wife and son have falsely been implicated in this case. The petitioner having no criminal antecedent is in custody since 23.06.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arra, in connection with Udwant Nagar P.S. Case No.136 of 2016..
