JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 294, 354A, 354B, 354D, 509 and 384 of the Indian Penal Code and Sections 8, 9 and 10 of the Protection of Children from Sexual Offences Act. The prosecution case is that the informant being the student of a school where the petitioner was teacher alleged that the petitioner talked with her in a vulgar language and tried to outrage the modesty of the informant and also gave his mobile number to the informant and asked her to talk. It is submitted by learned counsel for the petitioner that even assuming the accusation no offence either under Sections 354A,B,D of the IPC or Sections 8, 9 and 10 of the Protection of Children from Sexual Offences Act is made out. During

Patna High Court Cr.Misc. No.24217 of 2016 (2) dt.31-05-2016 2/2 departmental enquiry also exact accusation has not been ascertained. Moreover, the informant has subsequently retracted from her initial version also.

The aforesaid facts may constitute ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Amdabad P.S. Case No. 49 of 2016 pending in the court of learned Addl. Sessions Judge-I, Katihar. Accordingly, the application is disposed of.
