2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Barhara P.S. Case no. 50 of 2025 instituted for the offence under Sections 126(2), 115(2), 109, 74, 103 (1) and 3(5) of the BNS.
3. The case of the prosecution is that as the informant reached near Semra Bandh near the dam, Ravindra Rai @ doctor stopped him and took his gun in his hand. He was being told by the informant that one should not take the other weapons
Patna High Court CR. MISC. No.38047 of 2025(2) dt.11-07-2025 2/3 but unfortunately, trigger was pressed and two fires were made. It is further alleged that after this, all the petitioners arrived there and started assaulting him.
4. Learned counsel for the petitioners has submitted that petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that the nature of allegation against the petitioners is general and omnibus. It is also submitted that there is also a counter version of this case. Further submission is that co-accused namely, Bijendra Rai @ Buchi Rai @ Bucchi and Vivek Rai @ Vivek Kuymar @ Ganga @ Gunja has been granted bail by this Court vide order dated 25.06.2025 passed in Cr. Misc. No. 38375 of 2025. Further submission is that the petitioners are man of clean antecedent.
5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of his. arrest or surrender in connection with Barhara P.S. Case no. 50 of 2025,

No.38047 of 2025(2) dt.11-07-2025 3/3 he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, subject to the conditions as laid down under section 482(2) of the BNSS.
